As of my last update in September 2021, the Ministry of Corporate Affairs (MCA) in India allows for the filing of charge creation forms for companies registered under the Companies Act, 2013. A "charge" refers to the creation of a security interest over a company's assets, such as immovable property, movable property, or any other assets, to secure a loan or debt taken by the company.

Here's a general overview of the process of filing charge creation forms with the MCA in India:

1. Types of Charges:

There are various types of charges that a company may create, including mortgage, pledge, hypothecation, lien, etc. The specific type of charge will depend on the nature of the security interest created.

2. Form Filing:

The company creating the charge needs to file the relevant forms with the Registrar of Companies (ROC) within the prescribed time limit. The forms used for charge creation filing include:

   a. Form CHG-1: This form is used to create or register a charge.
   b. Form CHG-4: This form is used for the satisfaction of charges (i.e., when the charge is fully paid off or released).
   c. Form CHG-8: This form is used for the modification of charges (if there are any changes to the terms or conditions of the charge).


3. Time Limit:

The company must file Form CHG-1 within 30 days of the creation of the charge. If there is a delay in filing, additional fees will be applicable.

4. Required Documents:

The following documents are typically required for charge creation filing:

   a. Details of the charge created.
   b. Charge-related documents, such as the loan agreement, deed of mortgage, or any other instrument creating the charge.
   c. Board resolution authorizing the creation of the charge.
   d. Other relevant supporting documents, as applicable.

5. Digital Signature:

The form must be digitally signed by a director or company secretary.

6. ROC Approval:

Once the form is filed, the ROC will process the application. If everything is in order, the charge will be registered, and a Certificate of Registration of Charge will be issued.
