1. Applicability of GST for Professional Services:
Professional services such as legal, accounting, consulting, architectural, engineering, medical, and other similar services are liable to attract GST in India. The GST rate applicable for most professional services is 18%.
2. GST Registration:
Any individual or entity providing taxable professional services with an annual turnover exceeding the specified threshold (as of September 2021, the threshold was ₹20 lakh for most states) is required to register under GST. Voluntary registration is also allowed, even if the turnover is below the threshold.
3. Invoice Requirements:
Service providers must issue GST-compliant invoices for their services, which should include specific details such as the GSTIN (GST Identification Number) of the service provider and recipient, invoice number, date of invoice, description of services provided, service value, GST rate, and the amount of GST charged.
4. Input Tax Credit (ITC):
Professionals who are registered under GST can claim Input Tax Credit on the GST paid on their input goods and services. However, ITC cannot be claimed on goods or services used for non-business or personal purposes.
5. Filing GST Returns:
GST registered professionals are required to file regular GST returns. As of my last update, the most common return for regular taxpayers was GSTR-3B, which is filed monthly. Additionally, GSTR-1, which contains details of outward supplies, needs to be filed either monthly or quarterly, depending on the turnover.
6. Compliance Deadlines:
Timely compliance with GST returns and payments is crucial to avoid late fees and penalties. Different GST returns have specific due dates, and non-compliance can lead to fines and legal repercussions.
7. Reverse Charge Mechanism (RCM):
Under the RCM, the liability to pay GST is shifted from the service provider to the recipient of services for certain notified services. The recipient must pay GST directly to the government and comply with relevant reporting requirements.
8. Annual GST Audit:
Professionals with an annual turnover above the specified threshold (as of September 2021, ₹2 crores) are required to undergo a GST audit. The audit must be conducted by a Chartered Accountant or a Cost Accountant, and the audit report must be submitted along with the annual return (GSTR-9).
9. E-commerce Operator Compliance:
If a professional service provider is registered as an e-commerce operator, additional compliance obligations under GST may apply.
