Registration Process for Contract Labour Act

An Act to regulate the employment of contract labour in the specific establishment and provide for its abolition in certain circumstances and matters connected in addition to that.

It Applies:-
a) To every establishment in which ten or more workmen are employed or were employed on any day of the preceding twelve months as contract labour.
b) It shall not apply to establishments where work only of an intermittent or casual nature is performed.

Registration of Certain Establishment
Every principal employer of an establishment to which this Act applies shall make an application to the registering officer in the prescribed manner for registration of the establishment.



Description of the Process:

Step 1: The business entrepreneur (applicant) shall get ready according to the checklist.

Step 2: Fill up Form ’I’ in (triplicate for manual submission) according to the guidelines which are available in the Department Office/Website

Step 3: The filled up application is completed in all respect, and the prescribed fees are deposited either through treasury challan in the specified head of account in the Govt. Treasury or through “e-Payment” along with the required documents must be submitted to the ‘Facilator’ or the Registering authority.

Step 4: Submitted Forms and documents are verified by the Registering Officer and are officially processed.

Step 5:-
(a) If the application is found to be correct in all respect, the application is accepted, and a Certificate of Registration is issued to the applicant.
(b) If the application is incomplete/incorrect, then the application is rejected with a reasoned reply to the applicant.

Eligibility Criteria
Any entrepreneur/applicant intending to engage contractual workers can apply for the registration under the Contract Labour (Regulation & Abolition) Act, 1970, before the commencement of work.

Guidelines for Form Filing
  1. The relevant information in Form “I” in (triplicate for manual submission) is filled up in Block Letters with Black Ink.
  2. The application for registration of a new establishment should be made in triplicate to the registering officer of the area in which the establishment sought to be registered before the engagement of contractual workers. Signature is required only for manual submission of application Form.
Rule 26 Fees
The fees to be paid for the grant of a certificate or registration under Section 7 is specified below, namely:-

1000.00


Mode of Payment:
The requisite fees according to Assam Rules-26 should be deposited through treasury challan in the specified head of account.
The Heads of Accounts under which the receipt relating to the fees for registration shall be credited is “0230- Labour and Employment 106-Fees under the Contract Labour (Regulation and Abolition) Rules, 1971”.

Important Timeline

  • After verification, if the application is found to be correct in all respect, then the registration certificate is issued within 15 days from the date of receipt of the applications.
  • If the application is incorrect, then rejection with a reasoned reply will be issued within 15 days.
