Trademark registration forms in India

As of my last update in September 2021, the trademark registration process in India is managed by the Controller General of Patents, Designs, and Trademarks (CGPDTM), which falls under the Department for Promotion of Industry and Internal Trade (DPIIT), Ministry of Commerce and Industry. The trademark registration forms may have been updated since then, so it's always best to check the official website or consult with a legal professional for the most current information.

Here are the commonly used trademark registration forms in India:

1. Form TM-1: Application for Trademark Registration

This form is used for applying for the registration of a trademark in India. It contains details about the applicant, the trademark, and the goods or services associated with the mark.

2. Form TM-48: Authorization of Agent

If an applicant chooses to use a trademark agent or attorney to file the application on their behalf, this form authorizes the agent to act on their behalf during the registration process.

3. Form TM-50: Application for Renewal of Trademark Registration

This form is used to apply for the renewal of a registered trademark. A trademark in India is initially registered for a period of 10 years, and it can be renewed indefinitely for subsequent periods of 10 years.

4. Form TM-51: Application for Restoration of Trademark Registration

If a trademark registration has been removed from the Trademark Register due to non-renewal, it can be restored within one year from the date of removal by filing this form.

5. Form TM-52: Application for the Rectification of the Register or the Trademark

This form is used to apply for the correction of any errors or omissions in the trademark register or to rectify the trademark itself.

6. Form TM-54: Notice of Opposition to Trademark Application

Any interested party who believes they may be adversely affected by the registration of a particular trademark can file this form to oppose its registration.

7. Form TM-55: Counterstatement to the Notice of Opposition

This form is used by the applicant of a trademark to respond to the notice of opposition filed by a third party.

8. Form TM-58: Application for the Certificate of the Registrar under Section 41

This form is used to request a certificate from the Registrar of Trademarks, indicating that a trademark is registered.

Please note that the Indian government regularly updates its forms and procedures. To get the most up-to-date and accurate information regarding trademark registration forms and requirements in India, it's best to visit the official website of the Indian Trademark Office or consult with a trademark attorney or professional.
