2. Filing the Trademark Application

If the examination is successful and the application is accepted, the trademark is published in the Trademark Journal.

  • Opposition Period: Once published, there is a 4-month period during which third parties can oppose the registration of the trademark.
  • Opposition Handling: If an opposition is filed, the Registrar conducts a hearing to decide the matter. If no opposition is filed, or if the opposition is resolved in favor of the applicant, the trademark proceeds to registration.

5. Trademark Registration

If there are no objections or oppositions, or if they are resolved in favor of the applicant, the trademark is registered.

  • Registration Certificate: The Trademark Office issues a registration certificate, officially registering the trademark.
  • Validity: The trademark is valid for 10 years from the date of application and can be renewed indefinitely for successive periods of 10 years.

Post-Registration Requirements

  • Use of ® Symbol: Once registered, the trademark owner can use the ® symbol next to the mark, indicating that it is a registered trademark.
  • Renewal: The trademark must be renewed every 10 years to maintain its validity. A renewal application must be filed before the expiry date to avoid penalties.
