Compliance with Sexual Harassment of Women at Workplace Act in Bangalore
As of my last knowledge update in January 2022, the
Sexual Harassment of Women at Workplace (Prevention, Prohibition, and
Redressal) Act, 2013 is a legislation in India aimed at preventing and
addressing sexual harassment of women in the workplace. It requires employers
to create a safe and harassment-free working environment and mandates the
establishment of Internal Complaints Committees (ICCs) at workplaces with 10 or
more employees.
To ensure compliance with the Sexual Harassment of
Women at Workplace Act in Bangalore or any other location, employers should
take the following steps:
- Constitute
Internal Complaints Committee (ICC): Employers
are required to form an ICC at each office or branch where there are 10 or
more employees. The committee should include a presiding officer, two
members from employees, and one member from an NGO or an association
committed to the cause of women.
- Provide
Awareness and Training: Employers should
conduct regular awareness programs and training sessions for employees,
sensitizing them about what constitutes sexual harassment, how to prevent
it, and the procedures for reporting incidents.
- Create
a Policy: Organizations should have a clear
and comprehensive policy on preventing sexual harassment. This policy
should be communicated to all employees and made available in a language
understood by the employees.
- Display
Information: Display information related to the
Sexual Harassment of Women at Workplace Act, the policy, and details of
the ICC prominently in the workplace.
- Handle
Complaints Promptly: In case of any complaint, the
ICC should conduct a fair and impartial inquiry. The process should be
completed within a specific timeframe, and the complainant and the accused
should be treated with confidentiality and sensitivity.
Submit Annual
Reports: Employers are required to submit an annual report to the relevant
authority, detailing the number of cases filed, disposed of, and pending.
