What is Trademark class?

Trademark is segregated into 45 different classes as per the NICE classification for a trademark, also known as the International Certification of Goods and Services. Each of the trademark classes represents a distinct set of goods and services.

While filing a trademark registration application, it is necessary to do a trademark search to avoid discrepancies. It is essential to choose the right class of the trademark as the mark's wrong classification can hamper the registration process.

Trademark applications can be filed in more than one class if the business's activity involves various goods or services falling under different trademark classifications. Further, even if a registered trademark exists under one class, another entity can file a trademark application for the same mark under another class.

Hence, filing of trademark application under one class does not provide complete exclusivity over the mark's use. Trademark only includes exclusivity for the mark's use concerning the class of goods or services for which the trademark is registered. In India, trademark registration is done based on the Nice Classification system, which categorizes goods and services into different classes. The Nice Classification system is an international classification system used by most countries around the world. It helps to streamline the registration process and maintain consistency in trademark registration across different jurisdictions.

The Nice Classification system consists of 45 classes in total, with classes 1 to 34 designated for goods and classes 35 to 45 designated for services. Each class represents a distinct category of goods or services. Here is a detailed overview of each class:

Classes for Goods:

Chemicals - Includes chemicals used in industry, science, photography, agriculture, and horticulture, as well as unprocessed artificial resins, fertilizers, and fire extinguishing compositions.
Class 2:
Paints - Covers paints, varnishes, lacquers, preservatives against rust and deterioration of wood, colorants, and dyes.
Class 3:
Cosmetics and Cleaning Preparations - Includes cosmetics, perfumes, essential oils, hair care preparations, dentifrices, cleaning preparations, soaps, and toiletries.
Class 4:
Lubricants and Fuels - Covers industrial oils and greases, lubricants, dust absorbing, wetting, and binding compositions, fuels, and candles.
Class 5:
Pharmaceuticals - Includes pharmaceutical, veterinary, and sanitary preparations, dietetic substances adapted for medical use, and baby food.
Class 6:
Metals - Covers common metals and their alloys, metal building materials, transportable buildings of metal, and metallic goods.
Class 7:
Machinery - Includes machines and machine tools, motors and engines (except for land vehicles), machine coupling and transmission components, and agricultural implements.
Class 8:
Hand Tools - Covers hand tools and implements used by hand, cutlery, side arms, and razors.
Class 9:
Electrical and Scientific Apparatus - Includes scientific, nautical, surveying, electric, photographic, cinematographic, optical, weighing, measuring, signaling, checking, and teaching apparatus and instruments.
Class 10:
Medical Apparatus - Covers surgical, medical, dental, and veterinary apparatus and instruments, artificial limbs, eyes, and teeth.
Class 11:
Environmental Control Apparatus - Includes apparatus for lighting, heating, steam generating, cooking, refrigerating, drying, ventilating, water supply, and sanitary purposes.
Class 12:
Vehicles - Covers vehicles, apparatus for locomotion by land, air, or water.
Class 13:
Firearms - Includes firearms, ammunition, explosives, fireworks, and pyrotechnic products.
Class 14:
Jewelry - Covers precious metals and their alloys, jewelry, precious and semi-precious stones, horological and chronometric instruments.
Class 15:
Musical Instruments - Includes musical instruments and their accessories.
Class 16:
Paper Goods and Printed Matter - Covers paper, cardboard, printed matter, photographs, stationery, adhesives for stationery or household purposes, and office requisites.
Class 17:
Rubber Goods - Includes rubber, gutta-percha, gum, asbestos, mica, and goods made from these materials.
Leather Goods - Covers leather and imitations of leather, animal skins, trunks, suitcases, bags, wallets, and other goods made from these materials.
Class 19:
Non-Metallic Building Materials - Includes building materials (non-metallic), non-metallic rigid pipes for building, asphalt, pitch, and bitumen.
Class 20:
Furniture and Articles not Otherwise Classified - Covers furniture, mirrors, picture frames, goods (not included in other classes) of wood, cork, reed, cane, wicker, horn, bone, ivory, whalebone, shell, amber, mother-of-pearl, meerschaum, and substitutes for all these materials.
Class 21:
Housewares and Glass - Includes household or kitchen utensils and containers, combs, sponges, brushes (except paintbrushes), articles for cleaning purposes, glassware, porcelain, and earthenware.
Class 22:
Cordage and Fibers - Covers ropes, string, nets, tents, awnings, tarpaulins, sails, sacks, padding, cushioning, and stuffing materials (except of rubber or plastics).
Class 23:
Yarns and Threads - Includes yarns and threads for textile use.
Class 24:
Fabrics - Covers textiles and textile goods, bed and table covers.
Class 25:
Clothing - Includes clothing, footwear, headgear.
Class 26:
Fancy Goods - Covers lace and embroidery, ribbons and braid, buttons, hooks, and eyes, artificial flowers, and hair accessories.
Class 27:
Floor Coverings - Includes carpets, rugs, mats, and matting, linoleum, and other materials for covering existing floors.
Class 28:
Toys and Sporting Goods - Covers games and playthings, gymnastic and sporting articles (except clothing), decorations for Christmas trees.
Class 29:
Meats and Processed Foods - Includes meat, fish, poultry, and game, meat extracts, preserved, dried and cooked fruits and vegetables, jellies, jams, eggs, milk, and milk products.
Class 30:
Staple Foods - Covers coffee, tea, cocoa, sugar, rice, tapioca, sago, artificial coffee, flour, preparations made from cereals, bread, pastry, and confectionery, edible ices, honey, treacle, yeast, baking powder, salt, mustard, vinegar, sauces, spices, and ice.
Class 31:
Natural Agricultural Products - Includes fresh fruits and vegetables, seeds, natural plants, and flowers, foodstuffs for animals, malt.
Class 32:
Beers and Beverages - Covers beers, mineral and aerated waters, and other non-alcoholic beverages, fruit beverages, and fruit juices.
Class 33:
Wines and Spirits - Includes alcoholic beverages (except beers).
Class 34:
Smokers' Articles - Covers tobacco, smokers' articles, matches.

Class 35:
Advertising and Business Services - Includes advertising, business management, and administration, office functions, and commercial or industrial management assistance.
Class 36:
Insurance and Financial Services - Covers insurance, financial affairs, monetary affairs, real estate affairs.
Class 37:
Building Construction and Repair Services - Includes building construction, repair, installation services.
Class 38:
Telecommunications Services - Covers telecommunications.
Class 39:
Transportation and Storage Services - Includes transport, packaging, and storage of goods, travel arrangement.
Class 40:
Treatment of Materials Services - Covers treatment of materials, namely, custom manufacturing services, such as metalworking, glassmaking, and textile treatment.
Class 41:
Education and Entertainment Services - Includes education, providing of training, entertainment, sporting, and cultural activities.
Class 42:
Scientific and Technological Services - Covers scientific and technological services, research and design relating thereto, industrial analysis and research services, design and development of computer hardware and software.
Class 43:
Services for Providing Food and Drink - Includes services for providing food and drink, temporary accommodation.
Class 44:
Medical and Veterinary Services - Covers medical, hygienic, and beauty care services, veterinary and agricultural services.
Class 45:
Legal and Security Services - Includes legal services, security services for the physical protection of tangible property and individuals.
