An Act to regulate the employment of Contract Labour in certain establishment and to provide for its abolition in certain circumstances and matters connected therewith.
It applies:-
a. To every establishment in which ten or more workmen are employed or were employed on any day of the preceding twelve months as contract labour.
b. It shall not apply to establishments in which work only of an intermittent or casual nature is performed.
Registration of certain establishment : Every principal employer of an establishment to which this Act applies shall make an application to the registering officer in the prescribed manner for registration of the establishment.
Description of the Process
The process flow consists of five (5) steps viz-
Steps 1:- The business entrepreneur (applicant) shall get ready according to the check lists.
Steps 2:- Fill up Form ’I’ in (triplicate for manual submission) according to the guidelines which is available in the Department Office/Website
Steps 3:- The filled up application completed in all respect and the prescribed fees deposited either through treasury challan in the specified head of account in the Govt. Treasury or through “e-Payment” along with the required documents are to be submitted to the ‘Facilitator’ or the Registering authority.
Steps 4:- Submitted Form and documents are verified by the Registering officer and are officially processed.
Steps 5:- (a) If the applications is found to be correct in all respect than the application is accepted and a Certificate of Registration is issued to the applicant.
(b) If the application is found to be incomplete/incorrect, than the application is rejected with a reasoned reply to the applicant.
Any entrepreneur/applicant intending to engage contractual workers can apply for the registration under the Contract Labour (Regulation & Abolition) Act, 1970 before the commencement of work.
Rule 26 Fees
: The fees to be paid for the grant of a certificate or registration under Section 7 is specified below namely:-
If the number of workmen proposed to be employed on contract on any day-
(a) | is 10 ........................................ Rs. | 20.00 |
(b) | exceeds 10 but does not exceed 20 .............. Rs. | 40.00 |
(c) | exceeds 20 but does not exceed 50 .............. Rs. | 100.00 |
(d) | exceeds 50 but does not exceed 100 ............. Rs. | 200.00 |
(e) | exceeds 100 but does not exceed 200............. Rs. | 400.00 |
(f) | exceeds 200 but does not exceed 300............. Rs. | 600.00 |
(g) | exceeds 300 but does not exceed 400 ............ Rs. | 800.00 |
(h) | exceeds 400 but .............................. Rs. | 1000.00 |
Mode of Payment: The requisite fees according to Assam Rules-26 should be deposited through treasury challan in the specified head of account.
The Heads of Accounts under which the receipt relating to the fees for Registration shall be credited is “0230- Labour and Employment 106-Fees under the Contract Labour (Regulation and Abolition) Rules, 1971”.
